Make-My-Will.com (the Company) grants you a limited, non-exclusive, non-transferable right to use our Make-My-Will.com application and to view, download and print content, graphics and forms from the website for your personal use and not for republication, distribution, assignment, sublicense, sale, preparation of derivative works or other use other than to seek legal advice concerning your prepared will. The Company reserves the right to modify, amend, change, repeal or replace these terms at any time without notice to you. Your use of the website or the Make-My-Will.com application before, during, or after any such modification, amendment, change, repeal or replacement constitutes your acceptance thereof.

Exclusivity of Use

The right to use the Make-My-Will.com site cannot be transferred to or shared with any other individuals or entities.

Severability

Neither the course of conduct between the parties nor trade practice shall act to modify any provision of these terms. If any provision of the Terms of Use is declared invalid or unenforceable, the other provisions shall remain in effect

None of the information provided on this website is legal advice or should be relied on as legal advice. The Make-My-Will.com application will enable you to generate a last will and testament and other documents based on the information that you provide. You acknowledge that the last will and testament you obtain from this website was created by you without advice from the Company or any of its employees, owners, agents or affiliates. You agree to indemnify, defend and hold Make-My-Will.com and its employees, owners, agents and affiliates, and each of their successors and assigns, harmless from and against any and all losses, costs, expenses (including reasonable attorneys' fees and legal expenses), claims, damages and liabilities related to or associated with your use of this website or the Make-My-Will.com application and any violation of these Terms of Use by you.

Limitation on Liability

Neither Make-My-Will.com nor any of its employees, owners, agents or affiliates shall have any liability whatsoever for your use of any information provided on this website or the Make-My-Will.com application. In particular, but not as a limitation thereof, the Company and its owners, employees, agents and affiliates are not liable for any indirect, special, incidental or consequential damages, whether based on breach of contract, breach of warranty, tort (including negligence), product liability or otherwise, even if advised of the possibility of such damages.

Suitability

The Make-My-Will website and software is suitable for you to use if you can read and write in English; you understand why you need a Last Will & Testament and what having a Last Will, Living Will, and any other estate planning documents achieve; you live in any US state except Louisiana; you want simple legal documents that express your wishes clearly.

The Make-My-Will.com website and software is not suitable for your use to make a Last Will & Testament or Living Trust if you live in Louisiana; your possessions are worth more than $1,000,000; you want to disinherit your spouse; you want to disinherit a child of yours; you want or need complex Estate Planning documents for the avoidance of tax payments; you want or need detailed legal advice; you are providing for long-term care of a disabled person; you want two or more people to share a single item; you do not know which State is your permanent residence; you want to give property located outside of the US; you own a share of a business that's either unincorporated or a partnership or involves one or more people other than your spouse.

Payment

Payment gives you non-exclusive license to use the Make-My-Will.com website and provides the right to download and print Make-My-Will.com documents. Payment is by credit card, through the payment collection system being used for Make-My-Will.com at that time. By paying, you agree that your purchase will be bound by these Terms & Conditions, which constitute the complete contract between you and Make-My-Will.com

Pricing and User Account

The use of the Make-My-Will.com applications are enabled by your selection and entering of a Username and Password of your choice. After this information is entered, and payment is made, it is not possible to make changes to these selections, which will be necessary for you to access the application in the future. It is the responsibility of the user to retain this log-in information. All sales are final.

The pricing and charges made for the use of the application are subject to changes without any notice at any time.

Users selecting the standard Make-My-Will.com application will be able to produce and make changes to all documents currently available for a period of three months from the time that payment is made. During this period it will be possible to make changes and to make new hard copy prints of the documents. Once an order is placed for the use of this program, in accordance with these Terms and Conditions of Use, and Username and Password are issued, it is possible to use the program, but it is not possible to cancel the order. Under no circumstances will any refunds be made if requests to do so are made.

Users selecting the Lifetime Secure Storage option will be able perform the same changes to both content and prints over their lifetime.

Law changes

Whilst due care is taken by Make-My-Will.com to ensure any legal information provided is accurate, including but not exclusive to requirements for document witness requirements for US States, all legal documents produced using Make-My-Will.com are covered by federal laws and state laws, which are subject to change. Last Wills, Living Wills, Powers of Attorney and Living Trusts are governed by laws in the State where you live, and should be checked by the user with a local attorney within your State of residence.

Responsibility

Personal circumstances, law and taxation are subject to ongoing changes, and might necessitate change in any or all Estate Planning documents. Responsibility for conducting regular reviews of any document produced by Make-My-Will.com and for the making of needed changes is entirely that of the user.

The Company is not a law firm, and the employees and owners of the Company are not acting as your attorney. The software uses the answers provided by you to automatically complete legal forms. At no time do we review your answers provided by you for legal sufficiency, draw legal conclusions, provide you with advice or apply the law to the facts of your particular situation. You are totally and solely responsible for the information supplied, and for your own selections and actions.

Loss responsibility

Make-My-Will.com accepts no responsibility for any loss, injury, claim, liability or damage of any kind resulting from, arising out of or in any way related to any errors in or omissions from the Make-My-Will.com website or software, unavailability of any part of the Make-My-Will.com website or software, your use of any third party websites accessed through links in this website, your use of the Make-My-Will.com website and software. If any beneficiary or appointee named in your Last Will, Powers of Attorney or Living Will suffers a loss from the failure of either you or your heirs, or an appointee, to satisfactorily complete any needed functions related to any aspect of the use or processing of these documents, Make-My-Will.com will be indemnified by you or your estate against any claim that person may make, including attorney fees and Court costs. This clause applies to your use of any equipment or software in connection with the Make-My-Will.com website and software, any errors or omissions entered or not entered by you.

Make-My-Will.com shall have no liability or shall not be deemed to be in default for any delays or failures in performance under these Terms & Conditions resulting from acts beyond its control, including but not limited to acts of God, acts or regulations of any governmental or supranational authority, war or national emergency, terrorist activities, flood, rainfall, wind, fire or accident.

Updates

Updates will be made to both the content of the website, its software, and the documents it creates. Such changes will not be considered to be amended or altered by any written or oral statement to or action by, Make-My-Will.com in response to a specific customer. The Company reserves the right to amend this agreement at any time without notice. It is therefore important for the user to review this document any time you use this site. 

Disputes

Make-My-Will.com is administered by a California corporation. These Terms & Conditions of use are subject to the law of the State of California. Any disputes with Make-My-Will.com will be dealt with by the Courts of Tulare County in the State of California.
